On Wednesday (2), the Chamber of Deputies approved a bill that includes in the Penal Code the crime of psychological violence against women, punishable by imprisonment of up to two years and a fine, and that creates the Red Signal Against Violence cooperation program Domestic.
The project, authored by deputies Margarete Coelho (PP-PI), Soraya Santos (PL-RJ), Greyce Elias (Avante-MG) and Carla Dickson (PROS-RN), was approved in a symbolic vote and is going to the Senate.
The text, reported by Deputy Perpétua Almeida (PCdoB-AC), includes psychological violence against women in the section on crimes against personal freedom of the Penal Code.
The crime is described as “causing emotional damage to women that harms and disturbs their full development or that seeks to degrade or control their actions, behaviors, beliefs and decisions, through threat, embarrassment, humiliation, manipulation, isolation, blackmail, ridicule, limitation the right to come and go or any other means that harms psychological health and self-determination”.
The stipulated penalty is imprisonment from six months to two years and a fine, if the conduct does not constitute a more serious crime.
Also in the Penal Code, the bill adds a provision on the crime of domestic violence, within the chapter on bodily injuries, to indicate that if the injury is committed against the woman, for reasons of the female gender, the aggressor will be subject to imprisonment from one to four years.
The project changes the Maria da Penha Law to include psychological violence as a hypothesis so that the aggressor can be removed from the home, home or place of coexistence with the victim.
The text also creates the Sinal Vermelho against Domestic Violence cooperation program, aimed at women in situations of domestic or family violence.
The campaign seeks to establish a form of reporting so that the victim can go to a private establishment with the red “X” sign on the palm of the hand. The idea is that trained professionals, when viewing the request for help, call the Military and Civil Police to help the woman.
Executive, Judiciary, Public Ministry, Public Defender and Public Security agencies should create an immediate communication channel with private entities to provide assistance and security to the victim.
The identification of the code can be made by the victim personally in public offices and private entities across the country. The project determines the carrying out of an information and training campaign for professionals who belong to the program, so that the victim is referred for specialized care.
“This text is what we understand, there, a plea from the Judiciary for us to reduce domestic violence against women, violence of all forms against women as well,” said Congresswoman Celina Leão (PP-DF) , coordinator of the women’s bench at the Chamber.
