Sky News host Catherine McGregor says PM Scott Morrison’s decision to form National Cabinet is “coming back to bite him” as state premiers “trouser” Commonwealth funds behind borders they are arbitrarily closing in “breach of the Constitution”.
“This body has no constitutional status whatsoever,” Ms McGregor told Sky News host Alan Jones.
“It is governing by executive fiat and … it is coming back to bite the prime minister now as I predicted it would.
“Because the premiers are trousering Commonwealth money behind borders they are arbitrarily closing in absolute breach of s.92 and s.117 of our founding document.
“What he should have done … is expressly covered the field using the federal government’s power under quarantine, s. 51(ix), for the duration of this emergency and used the state police to do quarantine.
“And used Commonwealth facilities, army bases and so forth – instead of hotels.”
