Owner of Qualy margarine accuses Seara of copying packaging – 06/11/2021 – Panel SA

The purchase of Cremosy margarine by JBS for Seara’s portfolio was concluded just over six months ago and is already starting to make noise.

BRF, owner of Qualy margarine, went to court to accuse Seara of copying its packaging to confuse customers by changing the look of Cremosy after the acquisition.

The company asks that Seara immediately stop marketing the Cremosy units that are with similar packaging and collect the product from supermarket shelves.

In the process, which runs at the TJSP (São Paulo Court of Justice), BRF says that Seara made a “shameless copy” of Qualy’s packaging and would be practicing unfair competition.

The judge in the case, Eduardo Palma Pellegrinelli, determined that Seara should manifest itself until this Friday (11) on the request for urgent relief to stop selling the products.

BRF also asks for compensation of R$ 50 thousand for moral damages, in addition to an amount for the profits obtained with the margarines.

According to BRF, Qualy has the registration of a highly renowned trademark, given by the Inpi (National Institute of Industrial Property).

Sought by Panel SA, Seara says it does not comment on ongoing lawsuits.​
