Public Ministry of SP questions Sem Parar contracts with clients – 07/22/2021 – Panel SA

The Public Ministry of São Paulo, which has been questioning parts of Sem Parar’s adhesion contracts with its clients, managed to maintain an injunction against clauses that the agency considers abusive.

For the MPSP, the clause gives the company the power to open accounts and sign financing contracts on behalf of consumers, acting as their attorney.

The agency also says that Sem Parar’s defense alleges that its activity involves granting credit to the customer, as in credit card companies.

According to prosecutor Danilo Pugliesi’s argument in the public civil action, the general conditions of the contracts have clauses that can burden the client through financing contracts that he himself has not sought.

Sought by Panel SA, Sem Parar does not reveal the impact of the model on its accounts.

The company says that it acts in accordance with the law, ethics and transparency, and that its actions are informed to customers and are in accordance with the best practices in the means of payments market regulated by the Central Bank. “The company also clarifies that the process is in progress at the 1st instance and there has been no final decision yet,” says Sem Parar in a note.
