The court refused to interrogate the alleged employee of the Russian special services Konstantin Kudryavtsev, who owns the apartment, where the FBK lawyer (recognized as a foreign agent) Lyubov Sobol illegally entered. This is reported by the correspondent. TASS from the Perovskiy District Court of Moscow, which is considering a complaint against the convicted woman’s sentence.
“After listening to the views of the parties, the court ruled to refuse to summon witness Kudryavtsev to the court,” said judge Svetlana Aleksandrova. Sobol and her lawyer Vladimir Voronin petitioned for the interrogation of Kudryavtsev. According to them, Kudryavtsev is the owner of the apartment, into which the convict entered, and it was his interests that were harmed, based on the logic of the investigation. “Kudryavtsev is repeatedly mentioned in the case, but does not have any status there,” the lawyer said. The prosecutor objected to the questioning of Kudryavtsev.
Earlier, the magistrate’s court appointed Sobol a suspended sentence in the form of correctional labor for a period of 1 year with a deduction of 10% of the salary in favor of the state, having found her guilty of committing an act under Part 2 of Art. 139 of the Criminal Code of the Russian Federation (violation of the inviolability of the home, committed with the use of violence). The court found Sobol’s guilt fully proven.
According to the UK, on December 21, 2020, Sobol repeatedly tried to enter the apartment of an elderly woman in a house in the east of the capital, posing as an employee of Rospotrebnadzor. After two unsuccessful attempts, she misled the courier of the delivery service, introducing herself as an abandoned wife and stating that there was allegedly a small child in the apartment with whom she was not allowed to communicate. When the hostess opened the door, she pushed her away, burst into the apartment and went around all the rooms, filming her actions on the phone. Earlier it was reported that Sobol was looking for the alleged secret service officer Konstantin Kudryavtsev in the apartment. The victims in the case were Kudryavtsev’s mother-in-law Galina Subbotina and his wife. They own Kudryavtsev’s apartment on the basis of a gratuitous use agreement.
However, lawyer Voronin emphasized that the act of acceptance and transfer under this agreement was not provided in court and at the stage of investigation, and without it it is invalid.
