The leadership of the Specialized Anti-Corruption Prosecutor’s Office (SAP) in Ukraine for the second time overturned the decision of the prosecutor Vitaly Ponomarenko to close the Rotterdam + case, which related to the corruption scheme of the times of the former President of the country Petro Poroshenko for calculating the cost of coal. This was reported on Friday, April 16, by the National Anti-Corruption Bureau of Ukraine (NABU) in the Telegram channel.
“And about. the head of the SAP (Maxim Grischuk – Ed.) for the second time overturned the decision of the prosecutor Ponomarenko to close the Rotterdam + case. At the same time, Grischuk also canceled the order to reopen the investigation, which preceded the closure. Thus, the investigation did not lose precious procedural days, which are necessary for its completion and referral of the case to the court, ”follows from the message.
As noted in the NABU, Ponomarenko closed the Rotterdam + case three times, despite the evidence collected by the bureau. The closure of the case took place in August last year, in January and in April this year.
“NABU once again calls on Prosecutor General Irina Venediktova to replace the senior group of prosecutors in the Rotterdam + case. After all, the behavior of this prosecutor testifies to his bias. At the moment, only the Prosecutor General has the authority to replace Ponomarenko, but avoids making an appropriate decision, ”the statement says.
The NABU added that the bureau has sufficient evidence collected in production.
“The totality of the collected evidence in the proceedings, according to NABU, is sufficient for the court to determine the validity of the accusations of causing multibillion-dollar losses to the state and public interests through the“ Rotterdam + ”formula,” the NABU summed up.
The Rotterdam + methodology was applied in Ukraine from 2016 to 2019. It determines the cost of coal for thermal power plants when calculating the forecasted wholesale market price of electricity. As Ukrainian media reported, the delay in the investigation of the corruption scheme is due to the agreements of the former president of Ukraine with the anti-corruption agency.
The Bureau opened a criminal case against Rotterdam + in March 2017.
In December last year, NABU closed the case against Poroshenko on abuse of power due to lack of corpus delicti. According to the lawyer of the former President of Ukraine Ilya Novikov, in September 2020, 58 criminal cases were investigated against his client. In March 2020, NABU opened a case “on the fact of political persecution” of the politician.
